1. Acceptance of Terms

By accessing or using Markup ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Markup is an AI-powered platform that analyzes Congressional hearing videos. The Service transcribes hearing audio, generates summaries, tracks member remarks, and provides an interactive chat interface for exploring hearing content.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

4. Subscriptions and Payments

  • Markup offers free and paid subscription tiers. Paid plans provide higher usage limits and additional features.
  • All payments are processed securely through Stripe. By subscribing to a paid plan, you also agree to Stripe's Terms of Service.
  • Subscriptions renew automatically at the end of each billing period. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial billing periods. If you cancel, you retain access to paid features until the end of your current billing cycle.
  • We reserve the right to change pricing with 30 days' notice. Price changes do not affect your current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Submit content that you do not have the right to process
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Circumvent usage limits or access controls
  • Use automated scripts or bots to access the Service beyond normal usage
  • Resell, redistribute, or sublicense access to the Service without written permission

6. Content and Intellectual Property

  • Congressional hearing videos are public government records. Markup does not claim ownership of hearing content.
  • AI-generated summaries and analyses are provided for informational purposes only and should not be treated as official government records or legal documents.
  • You retain ownership of any content you create through the Service (e.g., chat conversations, notes).
  • The Markup platform, including its design, code, and branding, is our intellectual property.

7. AI-Generated Content Disclaimer

Summaries, member tracking, and chat responses are generated by artificial intelligence. While we strive for accuracy, AI outputs may contain errors, omissions, or misattributions. You should verify critical information against the original hearing video or official records. Markup is not liable for decisions made based on AI-generated content.

8. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Markup and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable rules.
